What is a Living Trust?

A “Living Trust” is an estate planning tool which functions to ensure that your wishes are adhered to and that your heirs avoid the lengthy, costly probate process.

The term “Trust” typically refers to a legal arrangement established by any individual or group to protect assets and direct the distribution of those assets after their death(s).  

This arrangement takes the form of a legal document which lays out the terms of the trust and the assets assigned to it.

During your lifetime, you retain full control of all of the assets assigned to your trust.  After your death, your assets are managed and distributed according to your wishes by a person you have chosen.

Not all “Trust Packages” are the same.

A Living Trust package can include a variety of documents. Some provide only a simple trust declaration. However, in order for your assets to be protected in the event that you are alive but unable to function, you will also need powers of attorney for financial administration and for health care decisions in place. A good trust preparer should also help you to “fund” your trust - meaning retitle or assign your assets to the name of your trust - otherwise, your property is not protected by the trust. An estate planning attorney should supervise the preparation of all of these documents.
